Iowa poll: Romney gains, Perry, Bachmann and Paul fall behind (Daily Caller)

Despite lacking a ground operation in the state, a new poll finds Mitt Romney displacing Rick Perry for primacy in Iowa. Meanwhile, Michele Bachmann ? who won the Iowa straw poll ? has fallen to second place, just above Perry.

A poll released Wednesday by American Research Group found Romney taking first with 21 percent, dropping Bachmann to second place with 15 percent and leaving her neck and neck with Rick Perry, who has 14 percent. Ron Paul takes fourth place with 12 percent.

Since announcing his candidacy the day after the Ames Straw Poll in August, Perry has displaced Bachmann as the frontrunner in the state. However, this poll suggests that his widely-panned debate performance ? during the period that voters were surveyed ? and the repeated attacks on his conservative values by other candidates, have started to take their toll.

Romney, in contrast, has shown a slight uptick in his percentage of the vote, up from 18 percent in July when ARG last polled. Other polls found Romney with a similar percentage of the vote since Perry entered the race.

Bachmann, who has staked her campaign on winning Iowa, appears to be in bigger trouble. When ARG polled in July, Bachmann had 21 percent of the vote ? similar to the results found by other pollsters as well. Once Perry entered the race, however, her percentage of the vote declined to somewhere around 18 percent in other polls, and 15 percent in this poll.

Though the decline is not so drastic as the one seen in national polls, where Bachmann?s share of the vote has dropped into single digits, it still suggests a slip.

The poll is based on telephone interviews with 600 likely Republican caucus goers from September 22 through September 27. The margin of error is plus or minus four percentage points.

Dementia patients suffer dubious hospitalizations (AP)

One-fifth of Medicare nursing home patients with advanced Alzheimer's or other dementias were sent to hospitals or other nursing homes for questionable reasons in their final months, often enduring tube feeding and intensive care that prolonged their demise, a new study found.

Nursing homes may feel hospital care is warranted when a frail, elderly patient develops swallowing problems, pneumonia or a serious infection, but researchers suspect a different motive for many transfers: money. Medicare pays about three times the normal daily rate for nursing homes to take patients back after a brief hospitalization.

"I think that's unfortunately a factor in what's happening here," said Dr. Joan Teno, a palliative care physician and health policy professor at Brown University. "A lot of this care just feels like in and out, in and out. You really have to question, is the health care system doing a good job or not."

She is a co-author of the study, published in Thursday's New England Journal of Medicine and done with researchers from Harvard University and Dartmouth Medical School.

Among the nearly 475,000 patients studied, 19 percent were moved for questionable reasons. The study provided no evidence that money motivated such transfers or that there was wrongdoing involved. However, the large variation that researchers saw from state to state suggests money may be playing a role.

Rates of such transfers varied from 2 percent in Alaska to more than 37 percent in Louisiana. In McAllen, Texas, 26 percent of study participants had multiple hospitalizations for urinary infections, pneumonia or dehydration ? conditions that usually can be treated in a nursing home. That compares to just 1 percent of patients in Grand Junction, Colo.

The researchers used Medicare records from 2000 through 2007 to identify "burdensome" transitions of care: moving patients in the last three days of life, moving them multiple times in the last three months of life, or moving them so they landed in a new nursing home afterward.

Medicaid pays on average $175 per day, depending on the state, for long-term care, but Medicare will pay three times that for skilled nursing care after a patient returns from three days or more in a hospital.

"If you have a nursing home that is operating on a margin, it adds up. It can be a tremendous incentive to hospitalize these people," Teno said.

Researchers found that patients who had a dubious transfer were more likely to have a feeding tube inserted, to spend time in intensive care in the last month of life, to have a severe bedsore or to be enrolled in hospice late (three days or less before they died).

Dubious transfers were more common with black patients, Hispanics and those without advance directives, legal documents spelling out care wishes.

The National Institute on Aging sponsored the study. One author consults for a nursing home system and owns stock in a long-term care information services company.

The study is important because more than 1.6 million Americans live in nursing homes, and nearly one-quarter of people admitted to one after hospitalization wind up back in the hospital within a month, Dr. Joseph Ouslander of Florida Atlantic University in Boca Raton and Dr. Robert Berenson of the Urban Institute in Washington, D.C., wrote in an editorial in the journal. Nursing homes may fear legal liability if they don't hospitalize a very sick patient, they wrote.

However, people with advanced dementia have a terminal condition.

"These are people who are unable to recognize their relatives, they're bed-bound and they're now usually having problems with swallowing. This is a population where the burdens of hospitalization often outweigh the possible benefits," Teno said. "These patients actually do better when they stay in a nursing home," where caregivers and surroundings are familiar, she said.

For families and nursing homes, "it may be difficult to recognize that in fact, this person is in the dying process," said Dr. Michael Malone, medical director of senior services for Aurora Health Care, a network of 15 hospitals in eastern Wisconsin. His 87-year-old father, Wendell Malone, died in January of advanced dementia in a nursing home that managed his care without frequent hospitalizations.

"It provided dignity, it provided comfort for the family," and let him stay in a place and with caregivers he knew, Malone said.

Beth Kallmyer, who runs programs for caregivers for the Alzheimer's Association, said the most important thing is to have a plan in place, with legal documents like "do not hospitalize" directives, before a nursing home has to make a decision about whether to hospitalize someone or instead focus on comfort care and not try to prolong life.

"When the time comes, the family will be able to say `This is what dad wanted,'" Kallmyer said.

She and other experts offered these tips:

_Involve patients in planning their care while they're still able to do so, and make sure wishes like "do not resuscitate" or "do not call 911" are spelled out in legal documents.

_Develop good relationships with nursing home staff and attending physicians so they understand the family's goals of care.

_Consider hospice care when seniors with advanced dementia are admitted.

_Revisit and review the plan whenever there is a change in a loved one's status. Someone may not be end-stage when they enter a nursing home but that can change.

_Seek advice. The Alzheimer's Association has a 24-hour toll-free number, 1-800-272-3900, with counselors to help families.

Perry ups ante with twist on Romney's '4 aces' (AP)

JEFFERSON, Iowa ? Call it a personal class war: Texas Gov. Rick Perry is trying to draw sharp class lines with his chief GOP presidential rival, the well-heeled former Massachusetts Gov. Mitt Romney.

"As the son of tenant farmers, I can promise you I wasn't born with four aces in my hand," Perry recently told about 200 central Iowa GOP activists. He grinned and then paused to allow chuckles to roll through the audience as the message became clear: Perry was a product of humble beginnings ? ordinary folk like them ? while Romney came from privilege.

The line was a riff on Romney's zinger during a debate in Tampa, Fla., when he suggested that Texas' job growth had more to do with the state's natural gas and oil supply than Perry's leadership.

When asked how much credit Perry deserves for the state's growing employment, Romney replied: "If you're dealt four aces, that doesn't necessarily make you a great poker player."

Perry's advisers apparently saw the crack as an opportunity to illustrate personality, background and, perhaps, character differences between Perry and Romney, the top two candidates in a GOP field that mostly agrees on major policy issues.

In Iowa and elsewhere, Perry has started linking himself to the middle class, if not to low-income Americans, and tying Romney to the nation's upper echelon. His larger strategy is to paint Romney as a pre-packaged politician out of step with everyday Americans, plant suggestions with Republicans feeling the pinch of tough economic times that Romney doesn't understand their plight, and undermine Romney's attempts to connect with middle-class voters.

Perry sees another opening with his I'm-like-you-and-he's-not argument: Tea party activists and other conservatives who dominate the GOP primary electorate are clamoring for an authentic candidate to challenge a Democratic incumbent they view as a detached elitist.

He's also using class to draw distinctions in part to counter criticism that he is not up to challenging Romney, who ran for the GOP nomination in 2008 and led in national polls for 2012 until the Texan entered the race last month.

Still, reflecting the sensitivity of the issue, Perry has stopped short of acknowledging publicly that he was drawing a direct comparison with Romney.

"This country that we live in is not a class society," Perry said when pressed recently by reporters in Iowa. "This country is based on hard work and vision and anyone who does that can achieve anything."

Not that his campaign was even making an effort at subtlety. In a sign of the sharp attacks to come, Perry aides sent out an email last week titled "Middle Class Mitt."

It noted that Romney has a net worth of more than $190 million and resurrected a Romney remark in which he seemed to suggest that he was part of "the great middle class ? the 80 to 90 percent of us in this country." It also highlighted Romney's comment to voters last June: "I'm also unemployed."

"Hundreds of millions in the bank. Beach and lake houses around the country. A successful career acquiring and dismantling companies and jobs," according to the Perry camp statement ? a script that read much like a possible future TV ad.

Perry's discussion of class differences comes as a debate rages in Washington between President Barack Obama, who is calling for higher taxes on the richest Americans, and the Republican-controlled House, which is accusing the president of "class warfare" as he seeks to rally support for legislation designed to boost the economy.

Within the GOP presidential primary, Perry's allies hope that he can sow mistrust of Romney, a multimillionaire former businessman born into a wealthy family, among conservatives who already are skeptical of the Northeastern Republican who has flip-flopped on a series of issues they hold dear.

The Perry strategy carries a risk: Discussions of class may invite increased scrutiny of Perry, who today lives comfortably thanks to Texas taxpayers.

Still, the differences between the two couldn't be clearer.

Perry, 61, was raised on a west Texas farm, attended Texas A&M University and worked on the family's farm after five years in the Air Force before entering politics in the 1980s. He has spent the last 27 years in elected office, including a decade as governor, and has a net worth of roughly $1.1 million.

But in small-town Iowa, Perry emphasized his up-by-the-bootstraps biography. He sketched a scene of his early life in west Texas, with its small churches and rural highways, familiar to many of the activists who attend the Iowa caucuses and the South Carolina primary, important early-voting contests next year.

"When I passed that county courthouse and that square, it was a good feeling to know I'm back in middle America where the values are really strong," he said during an appearance that showed him clearly at ease.

Conversely, Romney often is criticized as robotic and faces the challenge of personally connecting with voters. He is fighting the perception of an East Coast patrician, a caricature President George W. Bush successfully hung on his 2004 Democratic challenger John Kerry, a Massachusetts senator.

Romney, 64, was raised in an affluent Detroit neighborhood, the son of George Romney, a top automotive executive who became governor of Michigan. Romney attended Stanford, Brigham Young and Harvard universities and cut his own career in business, founding a successful investment capital firm.

He is well-known to GOP voters in early primary states given that he ran hard for the 2008 GOP nomination but lost.

Plain-talking Southern governors have done well in the Iowa caucuses. They include former Arkansas Gov. Mike Huckabee, who came from a poor family, in 2008 and then-Gov. George W. Bush of Texas, who was legacy to a powerful East Coast family, in 2000.

"There is an authenticity factor," South Carolina Republican activist Randy Page of Columbia, S.C., said of Perry. "And I think people here react to that."

Marker for Alzheimer's disease rises during day and falls with sleep

ScienceDaily (Sep. 26, 2011) ? A marker for Alzheimer's disease rises and falls in the spinal fluid in a daily pattern that echoes the sleep cycle, researchers at Washington University School of Medicine in St. Louis have found.

The pattern is strongest in healthy young people and reinforces a link between increased Alzheimer's risk and inadequate sleep that had been discovered in animal models. The brain's relative inactivity during sleep may provide an opportunity to finish clearing away the Alzheimer's marker, a byproduct of brain activity called amyloid beta. The body clears amyloid beta from the brain through the spinal fluid and other mechanisms.

In the new study, scientists report that the normal highs and lows of amyloid beta levels in the fluid that surrounds the brain and spinal cord begin to flatten in older adults, whose sleep periods are often shorter and more prone to disruption. In older adults with brain plaques linked to Alzheimer's disease, the ebb and flow is eradicated, and amyloid beta levels are close to constant.

The study is now online in Archives of Neurology.

"In healthy people, levels of amyloid beta drop to their lowest point about six hours after sleep, and return to their highest point six hours after maximum wakefulness," says Randall Bateman, MD, associate professor of neurology. "We looked at many different behaviors, and the transitions between sleep and wakefulness were the only phenomena that strongly correlated with the rise and fall of amyloid beta in the spinal fluid."

Bateman's laboratory conducted the study in partnership with Washington University's Sleep Medicine Center.

"We've known for some time that significant sleep deprivation has negative effects on cognitive function comparable to that of alcohol intoxication," says Stephen Duntley, MD, professor of neurology and director of the center. "But it's recently become apparent that prolonged sleep disruption and deprivation can actually play an important role in pathological processes that underlie diseases. This connection to Alzheimer's disease isn't confirmed yet in humans, but it could be very important."

Duntley notes that older adults often sleep less and have fewer periods of deep slumber. A number of factors linked to aging, such as reduced exercise levels, can disrupt the normal daily patterns of sleep and waking. These disruptions often become more pronounced as individuals age. The risk of Alzheimer's disease also increases with age.

Scientists studied three sets of subjects: a group age 60 and older who tested positive for the presence of amyloid beta plaques in the brain; a group in the same age range who did not have plaques; and a group of healthy persons age 18-60.

Researchers used a spinal tap to monitor amyloid beta in the spinal fluid hourly for 24 to 36 hours, and videotaped patients' activities and monitored their brain activity during that period.

In the group with brain plaques, amyloid beta levels were close to constant. But in the other two groups, the levels regularly rose and fell in a snakelike, sinusoidal pattern. The highs and lows of this pattern were much more pronounced in younger subjects.

Lead author Yafei Huang, PhD, statistical data analyst, reviewed the subjects' activities during the monitoring period at 30-second intervals. She grouped them into categories such as eating or drinking, watching television, using the bathroom, and using a computer or text messaging.

None of these activities could be closely correlated with changes in amyloid beta levels. But peaks in sleep and wakefulness, assessed both by videotape and by records of patients' brain activity levels, consistently occurred before the peaks and valleys of amyloid beta levels.

Researchers are currently testing if deliberate interruption of sleep in young healthy subjects disrupts the normal daily decrease in spinal amyloid beta.Scientists may follow these studies with tests of whether sleeping pills and other interventions that improve sleep help maintain the rise and fall of amyloid beta in the spinal fluid.

"It's still speculation, but there are tantalizing hints that better sleep may be helpful in reducing Alzheimer's disease risk," says Duntley. "We know from a number of studies that exercise enhances sleep, and research also has shown that exercise is associated with decreased risk of Alzheimer's. Sleep might be one link through which that effect occurs."

Facebook policies tricky for employers, workers (AP)

WASHINGTON ? In the age of instant tweets and impulsive Facebook posts, some companies are still trying to figure out how they can limit what their employees say about work online without running afoul of the law.

Confusion about what workers can or can't post has led to a surge of more than 100 complaints at the National Labor Relations Board ? most within the past year ? and created uncertainty for businesses about how far their social media policies can go.

"Employers are struggling to figure out what the right policies are and what they should do when these cases arise," said Michael Eastman, labor law policy director at the U.S. Chamber of Commerce.

In one case, a Chicago-area car salesman was fired after going on Facebook to complain that his BMW dealership served overcooked hot dogs, stale buns and other cheap food instead of nicer fare at an event to roll out a posh new car model.

The NLRB's enforcement office found the comments were legally protected because the salesman was expressing concerns about the terms and conditions of his job, frustrations he had earlier shared in person with other employees.

But the board's attorneys reached the opposite conclusion in the case of a Wal-Mart employee who went on Facebook to complain about management "tyranny" and used an off-color Spanish word to refer to a female assistant manager. The worker was suspended for one day and disqualified from seeking promotion for a year.

The board said the postings were "an individual gripe" rather than an effort to discuss work conditions with co-workers and declined to take action against the retailer.

Those cases are among 14 investigations the board's acting general counsel, Lafe Solomon, discussed in a lengthy report last month on the rise in social media cases. Solomon says federal law permits employees to talk with co-workers about their jobs and working conditions without reprisal ? whether that conversation takes place around the water cooler or on Facebook or Twitter.

"Most of the social media policies that we've been presented are very, very overbroad," Solomon said in an interview. "They say you can't disparage or criticize the company in any way on social media, and that is not true under the law."

The number of cases spiked last year after the board sided with a Connecticut woman fired from an ambulance company after she went on Facebook to criticize her boss. That case settled earlier this year, with the company agreeing to change its blogging and Internet policy that had banned workers from discussing the company over the Internet.

The National Labor Relations Act protects both union and nonunion workers when they engage in "protected concerted activity" ? coming together to discuss working conditions. But when online comments might be seen by hundreds or thousands of eyeballs, companies are concerned about the effect of disparaging remarks.

Doreen Davis, a management-side labor lawyer based in Philadelphia, said many of her corporate clients are often "surprised and upset" when they learn they can't simply terminate employees for talking about work online.

"All of us on the management side are being inundated with calls and inquiries from clients about this," Davis said. "A lot of companies want their social media policies reviewed or they want to establish one for the first time."

But the NLRB's Solomon also warns workers that not everything they write on Facebook or Twitter will be permissible under the law just because it discusses their job.

"A lot of Facebook, by its very nature, starts out as mere griping," Solomon said. "We need some evidence either before, during or after that you are looking to your fellow employees to engage in some sort of group action."

In one case, an employee at an Indiana emergency transportation and fire protection company was fired after writing on the Facebook wall of her U.S. senator, Republican Dick Lugar, to complain that her company skimped on wages and that its cheap service compromised the quality of care.

The NLRB's enforcement office declined to take up her case, saying that the employee didn't discuss her complaints with other workers or show any attempt to take employee complaints to management. She may have been trying to make a public official aware of problems with emergency medical services in Indiana, but board attorneys said that wasn't enough to protect her under the law.

While there are more than 100 cases pending before the board, only one has actually led to a formal ruling. Earlier this month, an administrative law judge at the agency found that a Buffalo, N.Y., nonprofit group illegally fired five workers after they posted Facebook comments complaining about workload and staffing issues.

The judge ordered the group, Hispanics United of Buffalo, to reinstate the five employees and award them back pay.

The Chamber of Commerce's Eastman said it's too early to criticize how the board is interpreting the law, but he wants to see what happens in closer cases where an employee goes "over the top" with criticism of a supervisor of employer.

"Where will the board draw the line between concerted activity and an employer's legitimate non-disparagement policy?" Eastman said.

Medical Bankruptcy: Fact or Fiction?

You have probably heard someone use the term "medical bankruptcy." This is a word commonly used by individuals who either are going through a medically related financial crisis, or are acquainted with someone who is facing severe medical debt. Although medical bankruptcy is not a legal term, it is a useful term to describe a financial remedy for an individual who may have reached the end of their rope because of medical debt.

Medical bankruptcy can be a misleading term because there is no legal remedy available exclusively for medical debt. In general, bankruptcy is the dissolution or reorganization of some or all of an individual's debt. When you file for any type of bankruptcy you must include all your debt. This would apply to home mortgage loans, car loans, credit cards, and medical debt. There are several types of bankruptcies, but most individuals filing a bankruptcy for medical debt will typically file for a Chapter 7 or Chapter 13 bankruptcy. A Chapter 7 bankruptcy may allow an individual to eliminate their debt, while a Chapter 13 bankruptcy can allow an individual to reorganize their debt into a 3-5 year plan, while at the same time reducing the principle on their debt.

The idea that a medical bankruptcy exists as a legal remedy may have developed because the court handles medical debt in a different way than they might other types of debt. Not all debt will receive the same treatment in court. A bankruptcy court will generally divide an individual's debt into two classes: Secured Debt or Unsecured Debt. Secured debt is the type of debt that is usually tied to assets like an auto loan or home mortgage. Unsecured Debt is usually not tied to assets, yet can often be eliminated or greatly reduced through a bankruptcy. It's important to realize that medical debt is usually classified as an unsecured debt.

While the term "medical bankruptcy" is not a legal term, it is a useful way for an individual to describe how their finances fell into chaos. An experienced bankruptcy attorney will immediately understand what a client needs when they inquire about a medical bankruptcy. A bankruptcy attorney can then inform them how a bankruptcy could be a solution to their financial hardship caused by medical debt, and even help the individual decide whether a Chapter 7 or Chapter 13 is most appropriate for their situation. AP IMPACT: Hospital drug shortages deadly, costly (AP)

TRENTON, N.J. ? A severe shortage of drugs for chemotherapy, infections and other serious ailments is endangering patients and forcing hospitals to buy life-saving medications from secondary suppliers at huge markups because they can't get them any other way.

An Associated Press review of industry reports and interviews with nearly two dozen experts found at least 15 deaths in the past 15 months blamed on the shortages, either because the right drug wasn't available or because of dosing errors or other problems in administering or preparing alternative medications.

The shortages, mainly involving widely-used generic injected drugs that ordinarily are cheap, have been delaying surgeries and cancer treatments, leaving patients in unnecessary pain and forcing hospitals to give less effective treatments. That's resulted in complications and longer hospital stays.

Just over half of the 549 U.S. hospitals responding to a survey this summer by the Institute for Safe Medication Practices, a patient safety group, said they had purchased one or more prescription drugs from so-called "gray market vendors"_ companies other than their normal wholesalers. Most also said they've had to do so more often of late, and 7 percent reported side effects or other problems.

Hospital pharmacists "are really looking at this as a crisis. They are scrambling to find drugs," said Joseph Hill of the American Society of Health-System Pharmacists.

A hearing on the issue was set for Friday before the health subcommittee of the House Energy and Commerce Committee. The Food and Drug Administration is holding a meeting Monday with medical and consumer groups, researchers and industry representatives to discuss the shortages and strategies to fight them.

The FDA says the primary cause of the shortages is production shutdowns because of manufacturing problems, such as contamination and metal particles that get into medicine.

Other reasons:

? Companies abandoning the injected generic drug market because the profit margins are slim. Producing these sterile medicines is far more complicated and expensive than stamping out pills, and it can take about three weeks to produce a batch. Making things worse, companies don't have to notify customers or the FDA that they've stopped making a medicine. That means neither FDA nor competitors can try to fill the gap.

? Only a half-dozen companies make the vast majority of injected generics. Even if other companies wanted to begin making a generic drug in short supply, they're discouraged by the lengthy, expensive process of setting up new manufacturing lines and getting FDA approval.

? Theft of prescription drugs from warehouses or during shipment.

? Secondary, "gray market" vendors who buy scarce drugs from small regional wholesalers, pharmacies or other sources and then market them to hospitals, often at many times the normal price. These sellers may not be licensed, authorized distributors.

Hospitals that buy scarce medicines from the "gray market" are taking a gamble.

The drugs may be stolen and hospitals can't always tell whether a medicine was properly refrigerated ? as required for many injectable drugs ? or whether it's past the expiration date, said Michael R. Cohen, a pharmacist and president of the institute. Either way, the active ingredient might have degraded and the drug might not work well or could harm the patient, he said.

Cohen attributes at least 15 recent deaths to drug shortages based on reports by medical personnel, but says many deaths and injuries go unreported.

In the worst known case, Alabama's public health department this spring reported nine deaths and 10 patients harmed due to bacterial contamination of a hand-mixed batch of liquid nutrition given via feeding tubes because the sterile pre-mixed liquid wasn't available.

So far this year, 210 drugs have been added to the list of drugs in short supply, one less than the total for all of last year, according to the University of Utah Drug Information Service, which tracks the shortages. That's triple the roughly 70 a year from 2003 to 2006, when shortages began to climb steadily.

"The shortages aren't resolving. They're piling up on top of existing ones," said Erin Fox, a pharmacist who manages the service. She said at least 55 drugs from shortages before this year are still unavailable or scarce.

The average price markup on drugs sold by secondary distributors was 650 percent, according to an Aug. 16 report by the Premier Healthcare Alliance, a group that helps U.S. hospitals and other health providers improve their patient care and finances. The report is based on an analysis of 636 unsolicited sales offers that were faxed and emailed to hospitals from secondary distributors in April and May.

Virtually every offer was for at least double the normal price, the survey found. The drugs with the highest markups were for critically ill patients needing anesthesia or other medicines for surgery or for emergency care, cancer, infectious diseases and pain management.

In an extreme case, one vendor was offering a generic drug for dangerously high blood pressure, normally priced at $25.90 per dose, for $1,200.

So far, hospitals have been absorbing the extra costs, but they'll soon have to start passing them on to insurers and patients, according to the American Hospital Association.

Hospitals sometimes have to cave in to save patients, according to Cohen and several hospital pharmacy directors.

The FDA says it must uphold quality standards but also works hard to prevent shortages.

"When FDA detects a contaminant, whether it be shards of glass or metal particles or an infectious agent, we have to take action to protect the public," said Dr. Peter Lurie, a senior adviser in the FDA commissioner's office.

When the agency orders a production shutdown, it urges other manufacturers to boost their output and expedites any approvals needed, said Valerie Jensen, associate director of FDA's drug shortage program. When raw materials used to make drugs are in short supply, the FDA tries to find new sources.

The agency averted 38 shortages last year, Jensen added.

Legislation pending in the House and Senate would increase penalties for drug thefts from warehouses and tractor-trailers. Another proposal, which has bipartisan support, would require drug manufacturers anticipating a shortage to immediately notify the FDA.

Sen. Amy Klobuchar, D.-Minn., the primary sponsor of the Senate version of the notification bill, said other solutions being considered include better tracking of medicine shipments, mandatory accreditation of distributors, stockpiling of key drugs and allowing routine imports of prescription drugs from countries such as Canada.

Distributors that supply about 90 percent of prescription drugs to hospitals buy direct from drug manufacturers and deliver only to customers with appropriate licenses, said John Parker, a spokesman for the Healthcare Distribution Management Association. He said HDMA members don't participate in the "gray market" but would not comment further.

The pitches hospitals get from the secondary distributors generally say they have small batches of specific drugs that are hard or impossible to find. I utilize over 60 vendors to locate and procure needed pharmaceuticals to assist when you have shortage needs," one reads.

Several distributors who sent hospitals solicitations for scarce drugs didn't return calls from the AP. One representative said he wasn't authorized to discuss the issue.

One company, Novis Pharmaceuticals, defended the higher prices, saying secondary distributors have to charge far more because they don't get the big rebates manufacturers give primary distributors. They also have high costs to locate and transport batches of scarce drugs, although the company, which mainly distributes blood plasma, would not disclose its profit margin.

It's illegal for companies to create a monopoly or collude to create a medicine shortage and raise prices, and there's no evidence of that. There's no federal law against price-gouging on prescription drugs, according to the FDA, but it does urge pharmacists to report cases to its Office of Criminal Investigation. An agency spokeswoman said she could not discuss whether any cases are being investigated.
